What to do to order via karrot.pl ?

1. You have to register, fullfiling form with delivery address (it can be changed later)

2. On the chosen cd site (for example: http://www.karrot.pl/czajczaj/cd) you need to choose amount and click "order"

3. Than you have to send money (ordered cd's plus shipping) on our bank account (possible payment methods and shipping costs avaialble in "Your basket" page)

4. When money appears on our account, you will get email confirmation and funds will be added to your account

5. When it's done click "Order" in "Your basket".

6. Order will be sent within 48h by Polish Post priority letter, also abroad.

What to do to buy MP3 or FLAC file?

1. You have to register

2. Send any sum of money on our account (possible payment methods and shipping costs avaialble in "Your basket" page)

3. When money appears on our account, you will get email confirmation and funds will be added to your account

4. On the chosen album site (for example: http://www.karrot.pl/czajczaj) you need to click "Buy" near chosen song or at the bottom of the list when you want to buy whole album.

5. Then "Download MP3" and "Download FLAC" icons will be activated for 7 days. Using them chosen songs can be downloaded. (all the bought songs will appear also in "Your Basket")

§ 1. General provisions

1. The following terms and conditions shall be applicable to all offers, orders, invoices and other documents produced by Agencja Koncertowo-Wydawnicza Karrot Kommando and to all agreements entered into with Agencja Koncertowo-Wydawnicza Karrot Kommando.

2. The present terms and conditions of sale and delivery shall be applicable to any orders placed with AGENCJA KONCERTOWO-WYDAWNICZA KARROT KOMMANDO. The terms and conditions below are deemed to have been accepted by the Buyer when an order is placed by the latter. General terms and conditions from the Buyer presented under any name whatsoever and deviating from the present terms and conditions of sale and delivery of AGENCJA KONCERTOWO-WYDAWNICZA KARROT KOMMANDO shall not be applicable and shall not be invoked against AGENCJA KONCERTOWO-WYDAWNICZA KARROT KOMMANDO unless explicitly agreed upon in writing by AGENCJA KONCERTOWO-WYDAWNICZA KARROT KOMMANDO.

3. The invalidity, nullity or unenforceability of any provision of the present terms and conditions of sale shall not affect the validity or enforceability of any other provision of the terms and conditions.

4. If the present terms and conditions of sale are also drawn up in a language other than English, the English terms and conditions of sale shall prevail at all times in the event of disputes.

5. The present terms and conditions of sale shall be available on www.karrot.pl/regulamin.

§ 2. Definitions

Following terms used in this general terms and conditions shall have the meanings set out below:

1. AGENCJA KONCERTOWO-WYDAWNICZA KARROT KOMMANDO - Piotr Maślanka, conducting business activity under the name of AGENCJA KONCERTOWO-WYDAWNICZA KARROT KOMMANDO with the seat in Zdzieszowice, Fabryczna Street 24 A/1, PL-47-330, hereinafter referred to as the Seller.

2. The Buyer - natural and/or legal person, owning the Seller's Account and placing the order and/or obtaining the Goods in the Seller's Internet Shop.

3. The Internet Shop, The Shop - the Seller's internet shop Karrot.pl conducted by the Seller on www.karrot.pl, responsible for realizing the Order.

4. The Price - the price of the Good compliant with the Shop's offer.

5. The Receiving - personal receiving of the Good ordered by the Buyer after the Realization of the Order.

6. The Shop's Offer - the Goods presented on www.karrot.pl.

7. The Registration - an action of the Buyer aimed on opening the Account in the Shop on www.karrot.pl.

8. The Registration Form - the form on www.karrot.pl, inclusive the personal data of the Buyer, necessary to be fulfilled for opening the Account in the Shop.

9. The Buyer's Account -the Seller's database entry, individual and unique, inclusive any and all the Buyer's purchases, payments and other actions in the Shop.

10. The Confirmation of the Order - shall take place along with using the link 'Order shipment' and/or 'Buy' towards the chosen Goods in 'Your Basket'.

11. The Good - the product and/or the music file in mp3 and/or Audio and/or Flac format, offered for sale by the Seller according to the Shop's Offer, which is the subject of the agreement between the Buyer and the Seller.

12. The Order's Value - the total value of ordered Goods including the delivery costs.

13. The Order - any and all Goods chosen in the Shop, confirmed ('added to the basket') by using link 'Order shipment' and/or 'Buy' to be delivered to the Buyer by the Seller.

14. Placing the Order ('add to the basket') - the declaration of will placed by the Buyer to the Seller aimed on concluding of the sale agreement.

15. The Parties - the Buyer and the Seller.

16. The agreement shall come into force on the present terms and conditions upon receiving the Confirmation of the Order by the Buyer. The place of concluding the agreement is the Seller's seat.

§ 3. The Buyer's Account

1. To buy any and all Goods in the Shop the Registration and opening the Account are essential. The Buyer shall fulfill the Registration Form, concurrently accepting the present terms and conditions. Shall the Buyer not accept the present terms and conditions any purchase order is possible.

2. The Registration, opening the Account and the revising of the Shop's offer are free of charge.

3. Any and all Buyer's purchases, payments and other actions in the Shop shall be registered on the Buyer's Account.

4. The Buyer is obliged to preserve its Account from third persons. The Buyer is also obliged not to disclose its name and/or the password to third persons. Furthermore the Buyer shall inform the Seller immediately about any and all attempts of unauthorized using of the Buyer's Account, name and/or password.

5. The Seller hereby declares and asserts that the Buyer's personal data, including the email addresses, shall be used by the Seller solely for the Order's Realization and shall not be disclosed to third persons.

6. The Buyer shall inform the Seller immediately about the change of its personal data necessary to Realization of the Order.

§ 4. Making payments on the Buyer's Account

1. To make any purchase in the Shop the Buyer shall pay the chosen optional amount of money on the Seller's bank account shown on 'Your basket' section in a way as set out in it. 4 of this Section 4. Before making payment The Buyer shall choose the currency of the transaction.

2. The amount paid by the Buyer shall not be smaller than 1 PLN (one polish zloty) or 1 EUR (one Euro) or 1 USD (one American dollar).

3. Each and every payment made by the Buyer shall be registered on the Buyer's Account subject to the provision 5 of this Section 4. Next payments made by the Buyer shall be totalized on the Buyer's Account.

4. The payments shall be made in the following way:

a) by bank transfer - on the Seller's bank account,

b) by PayPal service - www.paypal.pl.

5. Any and all payments made by the Buyer should be enlarged about the commission collected by the Buyer's bank or by PayPal service.

6. Each and every payment made by the Buyer shall be confirmed by an entry in 'Your Basket'. The Buyer is able to check its balance Account any time under 'Your Basket' link on www.karrot.pl.

7. The payment made by the Buyer shall be returned to the Buyer on its request, after set-off the commissions as set out in it. 5 of this Section 4. After Placing the Order the reimbursement of the payment is inadmissible. The reimbursement of the payment shall be made on the Buyer's account from which the payment was made.

8. After expiring of 60 days time period since the last payment was made by the Buyer on its Account, the Seller shall be authorized in each case to reimburse the unexploited amounts of money paid by the Buyer, after set-off the commissions as set out in it. 5 of this Section 4. The reimbursement of the payment shall be made on the Buyer's account from which the payment was made.

9. The Prices of the Goods include any and all necessary taxes, royalties and payments for entitled third persons, due under the copyright and/or intellectual property.

§ 5. Making of purchases

1. The purchase is being done by choosing the specified Good from the Shop's Offer and Placing the Order ('add to the Basket'), according to these terms and conditions and the indications on www.karrot.pl

2. The Orders placed on working days after 5 p.m., weekends or holidays shall be recognized on the next working day.

3. In case of purchase of the Good, excluding the music files, the Buyer shall use the link 'Order' concerning the chosen Good. The link 'Order' shall lead the Buyer to 'Your Basket' where the chosen Good shall be placed.

4. After finishing of Order's making the link 'Order shipment' should be used. The price due for the ordered Goods and their delivery shall be calculated automatically. Shall the Buyer accept the calculated price of the ordered Goods it finally confirms the purchase and shipping. After confirming of the purchase and shipping cancellation of the Order is inadmissible.

5. In the moment of confirming of the purchase and shipping of the Goods the calculated price for the ordered Goods shall be counted out from the Buyer's Account.

6. Each and every Good bought by the Buyer shall be sent as a priority shipment to the Buyer in 48 hours since the shipping is confirmed.

7. In case of purchase of any music file from the Shop, the Buyer shall use the link 'Buy' concerning the chosen music file. The link 'Buy' shall lead the Buyer to 'Your Basket' where the chosen music file shall be placed

8. For downloading the chosen music file the link 'Download' should be used. In the same moment the Buyer receives the access to the chosen music file. After starting the downloading process the cancellation of the Order is inadmissible, subject to the following provision.

9. In case of buying of any whole album the Buyer shall receive the discount due to the current Shop's Offer. In this case the cancellation of the Order is inadmissible.

10. In the moment of starting the downloading process the price for the ordered music shall be counted out from the Buyer's Account.

11. The Buyer shall keep the unlimited access to the bought music files for 7 days since the day of purchase.

12. Each and every Goods, excluding the music files, shall be sent along with the receipt. The invoice shall be drawn up on the Buyer's request. The necessary details should be sent to the Seller by an email addressed wysylki@karrot.pl.

§ 6. Making use of the Shop and the Buyer's obligations

1. Any and all Goods which have been made accessible by the Seller are the subject of copyrights and neighbouring rights and they are under protection due to the law in force, including particularly the polish Act of February 4th 1994 about copyright and neighbouring rights.

2. After saving the bought file on the hard disc, CD or any other data carrier, the Buyer:

• a. has the right to copying the bought file, exclusively for his personal use,
• b. does not have the right to send or copy the file to the third parties or distribute the file in any other way.   

3. Any and all music files made accessible to the Buyer's by the Seller are marked with the individual code of the Buyer, who bears exclusive and absolute liability for the infringement of the rules concerning the use of the bought music files, in particular for making them accessible to the third parties. Any technology of protecting the files from the unauthorized copying is the integral part of them.

4. The Buyer bears the absolute liability for the saving process of the music files on his own data carriers.

5. The Buyer cannot encourage or permit using or downloading the music files in order to their reproduction, elaborating, processing, projection, playing, broadcasting and/or transmission by any third parties.

6. After the download of the music file the Buyer bears exclusive liability in case of possible later erasing or damage to the bought file.

§ 7. Proceedings of complaint

1. Complaint is a notification made by the Buyer of a claim for a supply of the Good contrary to the Agreement.  The Buyer is responsible for checking the Goods upon delivery by the Seller and verifying that they are in satisfactory condition.

2. The Buyer is obliged to notify about all the complaints in writing, at the address of the Seller's business office or at the Seller's email address, within the time limit of 7 (seven) days since the day of the Buyer's declaration of a possible incorrectness in the Agreement execution.  There should be presented, at least, a short description of the incorrectness and the date of its appearance. The complained Good should be returned to the Seller in the original packaging. The cost of sending away of the Good will not be reimbursed.

3. The Seller considers the complaint submitted properly within the period up to 14 (fourteen) working days.

4. Reparation of the damage of which the Seller is liable for and created culpability of the Seller or gross negligence of the Seller ensues by the delivery of the ordered Good free of defects or by the reimbursement of the Price paid by the Buyer according to the Seller's choice, within the period of 14 days since the day of the positive consideration of the submitted complaint.

5. In case if the Seller will not be able to deliver the ordered Good or make the music file accessible as a consequence of force majeure, the Seller shall be entitled to the suspension of the delivery or termination of the Agreement with the immediate effect, whereas the Buyer shall not be entitled to claim any compensation in this case.

6. In case when the delivered Goods shall be forwarded by the Buyer, changed or divided or shall not be in the possession of the Buyer any longer, the Buyer shall withdraw all its claims as to the Goods affected by the hidden defects, whereas any claims within that range shall not be allowed.

7. The Seller's liability on grounds of the costs incurred by the Buyer or damages caused by the Seller will be in every case limited to the amount equal to the value of the Order placed by the Buyer. Under no circumstances shall the Seller be held liable for any indirect, special, incidental, punitive damage, consequential damage or product damage.

8. The Seller does not bear the liability of improper use of the Goods by the Buyer or any third person.

§ 8. Final provisions

1. The present terms and may be changed and modified by the Seller at any time by publication of the amendments at the internet site of the Shop without informing the Buyer about it. Any activity of the Buyer in the Shop after implementation of the amendments is equivalent to expression of acceptance of them.

2. The present terms and conditions shall be governed by and construed by Polish domestic law and each of the Parties hereto agrees to submit to the exclusive jurisdiction of the competent courts in Warsaw, Poland in respect of any claim or matter arising under the Agreement concluded due to these terms and conditions.

3. In the matters unsettled in the present terms and conditions the provisions of the Polish Civil Code, the Act about providing services by the electronic way and the Act about copyright and neighbouring rights shall apply.

4. The present terms and conditions shall come into force 03.03.2009.
